ORDER

Heard learned counsel for the petitioner, learned Government Pleader for Roads and Buildings for respondents 1 and 2 and learned Government Pleader for Revenue for respondents 3 to 5. 2.

This writ petition is filed seeking to declare the action of the 2nd respondent in laying the road in the patta land of the petitioner in Sy.Nos.11/AA/AA3 and 11 AA of Allapur Village, Toopran Mandal, Medak District, without initiating the land acquisition proceedings, as illegal and arbitrary.

The assertion of the petitioner is that the 2nd respondent had initiated steps for widening the existing road from Allapur Village to Imampur Village by encroaching upon his land, without issuing any notice to him.

Having regard to the facts and circumstances, the Writ Petition is disposed of, directing the respondents not to interfere with the petitioner's possession over the subject land without following due procedure prescribed under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act 30 of 2013). No order as to costs. 5.

Miscellaneous Petitions, if any pending in this writ petition, shall stand closed.
