Velupula Sunitha v. Velpula Naga Shyam
THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO Tr.C.M.P.No.553 OF 2017 ORDER:
Heard learned counsel for the petitioner.
The respondent, even several notices sent, refused and unclaimed respectively, hence sufficient service and taken as heard and perused the grounds urged in the transfer petition seeking to transfer the O.P.No.251 of 2017, filed by the husband against the petitioner/wife for restitution of conjugal rights pending before the Judge, Family Court, Warangal to Senior Civil Judge, Asifabad.
2.
It is her contention that she is unable to travel all the way for about 400 Kms distance from Kaghaznagar to Warangal. Asifabad Senior Civil Judge Court is very near to Kaghaznagar undisputedly, however, even by such transfer, the husband is also again to take the ordeal of travelling about 400 kms.
3.
Having regard to the above, the counsel for the petitioner suggested that Mancherial Senior Civil Judge Court is convenient for both parties which is at a distance of about 150 kms to both ends.
4.
Accordingly by considering the same, this transfer civil miscellaneous petition is allowed and the O.P.No.251 of 2017
is withdrawn from the file of Judge, Family Court, Warangal and transferred to Court of Senior Civil Judge, Mancherial. 5.
Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. There shall be no order as to costs.
