HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

With the consent of both counsels, matter is taken up as lunch motion.

2. This Civil Revision Petition is filed challenging the order of granting police protection on 09.03.2016 in I.A.No.157 of 2016 in I.A.No.144 of 2016 in O.S.No.49 of 2016 on the file of Junior Civil Judge, Tadipatri. Learned counsel for petitioners primarily contended that order passed by the Court below is without notice to the petitioners.

3. At this stage, learned counsel for petitioners as well as counsel for respondents have agreed for remitting the matter to the Court below for re-consideration of I.A.No.157 of 2016 after hearing both sides.

4. Having regard to the same, order under appeal is set aside and matter is remitted to the Court below for re-consideration of I.A.No.157 of 2016 after hearing both sides.

Counsel for parties shall present themselves before the Court below on the next date of hearing and make their submissions. Accordingly, the Civil Revision Petition is allowed. However, it is made clear that all contentions are left open. No costs. Miscellaneous petitions if any pending in this revision shall stand closed.
