Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. The case of the petitioner is that her father, out of love and affection, transferred the property bearing Door No.49-54-9/3, Flat No.202, II Floor, Swarnajayanthi Towers, S.R.O. Dwarakanagar, Visakhapatnam District, in favour of her daughter by way of gift settlement deed dated 16.02.2005. The petitioner states that to meet some urgent financial commitments relating to her minor daughter's education, she intended to sell the property and accordingly approached the 3rd respondent and presented the deed of conveyance for registration. However, the 3rd respondent refused to register the said document stating that the same is barred from registration in terms of the Circular Memo No.G1/9916/2013, dated 03.08.2013.
Aggrieved by the said Memo, the petitioner filed the present Writ Petition. In view of the same, the Writ Petition is disposed of directing the 3rd respondent to receive and process the document submitted by the petitioner for the purpose of registration and if he is not inclined to register it, he shall pass an order thereon under Section 71 of the Registration Act, 1908 and communicate the same to the petitioner within four weeks from the date of submission of the document by the petitioner otherwise register the same. There shall be no order as to costs.
As a sequel, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
