This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused No.4, seeking a direction to the Court of learned Additional Judicial Magistrate of First Class, Giddalur, Prakasam District, to expedite hearing of the case in C.C.No.4 of 2012 pending before the said Court.

There is no representation for the petitioner/ accused No.4. The learned Public Prosecutor (Andhra Pradesh) appearing for the 1st respondent-State would submit that the petitioner/ accused No.4 was absconding for a considerable period and therefore, the trial Court is not proceeding with the trial after closure of the prosecution evidence, so the petitioner wanted to seek a direction to expedite the proceedings in C.C.No.4 of 2012 on the file of the learned Additional Judicial Magistrate of First Class, Giddalur, Prakasam District. 3 .

As per the record placed, the Investigating Officer was examined on 14.12.2015 and the matter was posted for 313 examination. Thereafter, the accused No.10 absconded. So the matter is not proceeded with.

Under these circumstances, the trial Court is directed to split up the case against the accused No.10 and proceed with the trial in the Calendar Case against the other accused and

Dr.SA, J CRL.P.No.447 of 2017 conclude the proceedings within a period of three (03) months from the date of this order.

The Criminal Petition is disposed of accordingly. Pending miscellaneous petitions, if any, in this Criminal Petition, shall stand closed.
