HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27417 OF 2017 ORDER:

The case of the petitioner is that she was working as Sweeper-cum-Washer woman since 2004 in Sri Pattabhirama Swamy Temple, Valmikipuram, Vayalpadu, which is managed by the TTD; that there are several other persons working in the same temple along with the petitioner and that by proceedings dated 13.06.2006, the TTD has sanctioned enhancement of 'Sambhavana' from Rs.50/- per day to Rs.3,975/- per month to all the staff with effect from 20.01.2005. Thereafter, the TTD issued proceedings dated 12.02.2008, whereby it has decided to extend minimum time scale of pay in the Revised Pay Scales 2005 to the employees working in various temples taken over by it. Among the said temples taken over by TTD, Sri Pattabhirama Swamy Temple, where petitioner is working is also there. Thereafter, consequential proceedings dated 29.08.

2008 were issued, whereby the minimum time scale of pay has been extended to the persons working in the said temple. But, the said benefit was not given to the petitioner. The petitioner is also entitled for the said benefit of payment of salary in the minimum time scale along with other persons working with her, but unfortunately the same was not extended to the petitioner. As such, the petitioner made several representations to the respondent but, the respondent orally assured the petitioner that it would consider the same.

the said benefit of minimum time scale, she will be entitled for atleast Rs.12,000/- per month. The petitioner again submitted representation dated 03.08.2017 to the respondent. But, no action has been taken by the respondent. The petitioner is continuing even now on the consolidated pay of Rs.3,975/- per month. Aggrieved action of the respondent in not extending the benefit of minimum time scale to her on par with other similarly situated employees, present writ petition is filed. Heard Sri Vedula Srinivas, learned Senior Counsel appearing for the petitioner who submits that in the list shown in proceedings dated 13.06.2006, by which the respondent enhanced 'sambhavana' to the staff of the Sri Pattabhirama Swamy Temple, petitioner's name is found, whereas in the list shown in proceedings dated 29.08.2008 by which minimum time scale was extended to the staff of the temple, petitioner's name was omitted without any reason and that the benefit of minimum time scale was not extended to the petitioner. Heard Sri A.K.Jayaprakash Rao, learned Standing Counsel for the TTD.

Since the grievance of the petitioner by way of representation is pending before the respondent, without expressing any opinion on merits, the respondent is directed to consider the representation of the petitioner by taking the aforesaid facts and circumstances into account, within a period of four weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand dismissed.
