This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioners/ accused Nos.1 to 3 and 5 seeking to quash the proceedings in C.C.No.650 of 2017 on the file of VII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, by which, the petitioners/ accused Nos.1 to 3 and 5 are being prosecuted for the offence alleged under Section 295A read with 34 I.P.C. 2 .

Heard learned counsel for the petitioners/ accused Nos.1 to 3 and 5, learned counsel for respondent No.2/ complainant and the learned Additional Public Prosecutor representing respondent No.1/ State. Perused the record.

In the course of submissions, it is brought to the notice of this Court that the parties have compromised the subject matter. The offence alleged against the petitioners/ accused Nos.1 to 3 and 5 is under Section 295A read with 34 I.P.C. The same is not compoundable, as per the provisions under Section 320 Cr.P.C. As far as the merits of the case is concerned, there are sufficient grounds to proceed against the petitioners/ accused Nos.1 to 3 and 5 for the offence alleged under Section 295A read with 34 I.P.C. The petition is devoid of merit and is liable to be dismissed.

At this stage, a request is made by the learned counsel for petitioners/ accused Nos.1 to 3 and 5 to direct the trial Court to

expedite the trial of the subject Calendar Case. Under these circumstances, the trial Court is directed to dispose of the subject Calendar Case within a period of three (3) months from the date of receipt of a copy of this order.

With the above direction, the Criminal Petition is dismissed.

Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
