SMT JUSTICE T.RAJANI CRIMINAL PETITION No.1982 OF 2018 ORDER:

This Criminal Petition is filed seeking modification of the order passed by the XIII Addtinal Session Judge-cumMetropolitan Sessions Judge, Cyderabad at L.B.Nagar dt.06.12.2017 in Crl.MP.NO.642 of 2017 in Crl.A.No.1287 of 2017.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record.

By virtue of the said order, the Court below, while suspending the suspension imposed against the petitioner, ordered 25% of the compensation amount to be paid within two (02) months from the date of order.

The compensation amount being Rs.28,00,000/-, the counsel for petitioner submits that the petitioner has undertaken construction work and he went in huge losses and he is not in a position to pay the said amount and that he has good grounds in succeeding the appeal. 5.

Considering the above, this Criminal Petition is allowed and the amount, which is to be deposited by the petitioner, alone is modified and reduced from 25% to that of 10% of the compensation amount and directed to deposit within a period

of two (02) months from this date. The other conditions imposed by the Court below shall remain unaltered. 6.

Consequently, miscellaneous applications, if any pending, shall stand closed.
