This Criminal Petition is filed under Section 438 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking anticipatory bail to the petitioner-Accused in Crime No.6364 of 2023 on the file of Vigilance & APTS Police Station, Sangareddy District, registered for the offence under Section 135 of the Electricity Act, 2003. 2.
Heard the learned Counsel for the petitioner and the learned Additional Public Prosecutor for the respondent-State. 3.
Learned counsel for the petitioner submitted that the petitioner was arrayed as accused in Crime No.6364 of 2023 dated 28.06.2023 on the file of Vigilance & APTS Police Station, Sangareddy District. It was alleged that the petitioner had indulged in theft of energy dishonestly for domestic purpose and earlier also a case was booked against him and the present case was the second offence committed by the petitioner. He further submitted that the petitioner had already paid fine of Rs.3,452/- and prayed to grant anticipatory bail to the petitioner.

Learned Additional Public Prosecutor stated that a notice under Section 41-A Cr.P.C. was served on the petitioner on 11.07.2023, but he did not appear before the Investigating officer, as such, prayed to dismiss the bail application of the petitioner. 5.
Perused the record. Considering that the fine amount was stated to be paid by the petitioner, it is considered fit to grant anticipatory bail to the petitioner on certain conditions. 6.
Accordingly, the Criminal Petition is allowed and the petitioner-Accused is granted anticipatory bail subject to the following conditions:
1. The petitioner-accused is directed to surrender before the Station House Officer, Vigilance & APTS Police Station, Sangareddy District within a period of (15) days from the date of this order and on such surrender, the said Station House Officer shall release the petitioner on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer.

2. The petitioner-accused shall abide by the conditions stipulated under Section 438(2) of Cr.P.C.
