HONOURABLE SRI JUSTICE N.V.SHRAVAN KUMAR WRIT PETITION (TR) No.2355 OF 2017 ORDER:

This writ petition (TR) is filed seeking to set aside the proceedings of respondent No.6 vide File No.PIO/III/ M-1447/SP 885/2011-01 dated 01.08.2011 and direct the respondent authorities to include as per the section 49 revised pension rules 1980 the name of first and second wife of the petitioner as family pension beneficiary.

Today when the matter has been taken up for hearing, learned Government Pleader for Services-II appearing for respondents submits that the counter-affidavit is filed by the respondents wherein, Para No.5 reads under:

"Accordingly, the pension papers have been forwarded to the Accountant General (A&E) Andhra Pradesh, Hyderabad vide Superintending Engineer, RWS&S Circle, Medak at Sangareddy Letter No.B1/Van Driver Rtd/08/2010, dated 14.11.2014. In turn the Accountant General (A&E) Andhra Pradesh & Telangana, Hyderabad in its order in letter No.PAG (A&E)/AP/PIO/IV/M 1447/SP 885/2011-01/2118, dated 05.01.2015 stated as follows "Family Pension authorized in two equal shares (1) to Smt. Ameena Begum 1st wife of Sri.Md.Ismail and (2) to Smt.Sabera begum 2nd wife of Sri.Md.Ismail as per pension sanctioning Authority Letter No.A1/Estt/1551/2014, dated 18.11.2014 family pension may be paid in equal share to Smt.Ameena Begum 1st wife and Smt.Sabera Begum 2nd wife of Sri.Md.Ismail as per Letter dated 18.11.2014." 3.

Learned Government Pleader for services-II submits that in view of the proceeding dated 05.01.2015 issued by the respondent

authorities, the petitioner case is considered and further submits that the cause in the writ petition (TR) does not survive for further adjudication.

At this stage, learned counsel for the petitioner submits that he has no instructions from the petitioner and further submits since the case of the petitioner is considered and cause in the writ petition (TR) does not survive for further adjudication, writ petition (TR) may be closed.

Recording the submissions made by the learned counsel on either side, this Writ Petition (TR) is closed. 6.

Miscellaneous applications, if any pending, shall stand closed. No order as to cost.
