THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5366 of 2018 ORDER:

The petitioner states that she is a landless poor person and she was assigned an extent of Ac.0.30 cents in Survey No.200/5 and an extent of Ac.0.30 cents in Survey No.200/6A situated at Thimmapuram Village, Mahanandi Mandal, Kurnool District, under a DKT patta dated 17.03.1999. The pattadar pass books and title deeds were also issued in respect of the said land after conducting enquiry. She also dug a bore-well in the said land and obtained electricity connection also. While so, the fourth respondent issued notice on 17.01.2018 to nine ryots, including the petitioner, stating that a portion of the Government land situated in Survey No.200/1 was encroached and the petitioner was asked to appear before him on 22.01.2018. She states that she appeared before the fourth respondent, who refused to receive the documents.

She further states that on 14.02.2018 the fourth respondent visited her land and took measurements. Apprehending interference with the said land, the present Writ Petition is filed. The notice reveals that the fourth respondent wanted to conduct an enquiry in respect of the land situated in Survey No.200/1 and the allegation against the petitioner is that she occupied a portion of the Government land situated in the said survey number. But, the petitioner is claiming Ac.0.60 cents of land under a patta granted on 17.03.

patta granted on 17.03.1999, the said land of Ac.0.60 cents shall not be interfered, except following due process of law. If any portion of the Government land was occupied by the petitioner, it is open to the fourth respondent to take possession of the same without issuing any further notice. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
