THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY TRANSFER C.M.P.NO.641 OF 2015 O R D E R:

This transfer C.M.P. is filed by the petitioner-wife against the respondent-husband for transfer of H.M.O.P.No.79 2015 from the file of Senior Civil Judge, Chirala, Prakasam District to the Family Court at L.B.Nagar, Ranga Reddy District. The case of the petitioner is that her marriage with respondent took place on 02.12.2004 at Choppukatla Palem Village, Errupalem Mandal, Khammam District as per Hindu rites and customs and out of their wedlock, two children were born to them. Three years after their marriage, the petitioner was subjected to cruelty and the respondent filed H.M.O.P.No.79 of 2015 seeking divorce, on the file of the Senior Civil Judge, Chirala. Now the petitioner and her children are residing with her brother at Hyderabad and the petitioner is pursuing her B.Com. II year at Habsiguda, Hyderabad. The learned counsel for the petitioner submits that as the petitioner is pursuing her studies at Hyderabad, she is not in a position to travel all the way from Hyderabad to Chirala along with her children.

Though notice is issued to the respondent, no counter is filed and there is no appearance on his behalf. Since the averments made by the petitioner in support of the transfer petition are not controverted and the petitioner and her two children are pursuing their studies at Hyderabad, I am of the opinion that it may be difficult for the petitioner to travel all the way from Hyderabad to Chirala, Prakasam District. In view of the above facts and circumstances of the case, Transfer C.M.P. is allowed. Miscellaneous petitions pending, if any, shall stand closed.
