HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.16302 of 2017 ORDER:
1) The present writ petition came to be filed with the following relief:
" seeking issuance of writ of mandamus declaring the action of the respondents in not taking the complaint submitted by the petitioners as regard to the stoppage of quarry operations by respondent Nos.7, 8, 9 and 10 and the action of respondent No.6 in not registering the complaint lodged by the petitioner and not taking action against respondent Nos.7, 8, 9 and 10 quarry operations conducted by the petitioner pursuant to the quarry lease granted by the Director of Mines and Geology in proceedings No.915/ R2-3/ 2013 dated 29.09.2016 as arbitrary, illegal, unjust, unconstitutional and in violation of Article 21 of the Constitution of India.
2) Learned counsel for the petitioner submits that the writ petition came to be filed questioning the inaction of the police basing on the report said to have been given by the petitioner to the Station House Officer, Pangal with regard to alleged trespass and interference with the mining operations of the petitioner. 3) The learned A.G.P. for Home (TG) on instructions, submits that the concerned Station House Officer has not received any complaint from the petitioner.
4) As seen from the record, the copies of the complaints were submitted before the office of the Sub-Divisional Police Officer, Wanaparthy and not before the Station House Officer, Panagal Police Station. At this stage, learned counsel for the petitioner would submit that the petitioner may be permitted to submit a fresh report to the concerned Station House Officer, in which event the respondents may be directed to act on the said representation.
5) Recording the said submission, the writ petition is disposed of directing the petitioner to submit a fresh report to the Station House Officer concerned, in which event the same shall be dealt with in accordance with law.
6) There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
