HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 17422 of 2002 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in conducting enquiry without supplying the documents mentioned in the representations dated 26.07.2002 and 02.08.2002 submitted by the petitioner, as illegal and arbitrary. A consequential direction is also sought to the respondents to proceed with the enquiry only after supplying the material documents mentioned in the said representations. On 12.09.2002, this Court, while admitting the writ petition, passed an interim order in WPMP No.21851 of 2002 directing the respondents to dispose of the representations dated 26.07.2002 and 02.08.2002 of the petitioner within two weeks. In view of the same, the cause in the writ petition does not survive.
Further, at the time of filing of the writ petition, the petitioner was aged 47 years and, by this time, he must have attained the age of superannuation. Therefore, the writ petition is dismissed as infructuous. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
