HON'BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION No.5186 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies appearing for the respondents.

2. This writ petition is filed seeking to declare the action of the 2nd respondent in passing the order of recovery of an amount of Rs.3,37,367/- from the petitioner in 6-A Case No.CS6/120/2012 of the E.C. Act, 1955 dated 04.12.2014, as arbitrary and illegal.

3 . Learned counsel appearing for the petitioner submits that the 4th respondent filed a complaint before the 2nd respondent under Section 6-A of the Essential Commodities Act, 1955 alleging certain irregularities against the petitioner.

4. Admittedly, from the impugned order passed by the District Collector, Adilabad, an appeal lies to the District and Sessions Judge. The petitioner is having efficacious remedy of appeal, which he can avail. Therefore, this Court is not inclined to entertain this writ petition.

5 . Hence, the writ petition is dismissed at the stage of admission, with a direction to the petitioner to approach the Appellate Authority and to file a regular appeal. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No order as to costs.
