Nagi Reddy Mandadi, Petitioner/Accused 6 AND The State of Telangana, Rep. by its Public Prosecute High Court at Hyderabad Respondent Petition under Section 438 of Cr.P.C, praying that in the circumstances stated in the affidavit filed in support of the Criminal Petition, the High Court may be pleased to enlarge the Petitioners on bail in the event of his arrest in connection with FIR No. 46/2019 dated.13.03.2019 on the file of the Wanaparthi Town PS for offence under section 302 read with 34 IPC The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof upon hearing the arguments of SYED KHADER MASTAN Advocate for the Petitioner and the PUBLIC PROSECUTOR ,Advocate for the Respondent, the Court made the following.
ORDER:
This Criminal Petition, under Section 438 of .the Code of Criminal Procedure, 1973, is filed by the petitioner/A.5, for grant of anticipatory bail in Crime No.46 ol 2019 of Wanaparthy Town Police Station, Wanaparthy District, registered for the offence punishable under Section 302. read with 34 of lPC. 2.
Heard the learned counsel for the petitioner/A.6, the learned Additional Public Prosecutor representing the res pondent-State and perused the record. 3.
As per the confession made by A.1 to A.5 in this crime, the petitioner/A.6 promised to support A.1 to A.5 in eliminating the deceased Raghavendra Swamy @ Raghu. lt is also confessed that this petitioner/A.6 brought his Swift car, picked up A.2 to A.5 from the scene of offence and shifted them to different places. As seen from the record, there are no disputes or grudge in between this petitioner/A.6 and the deceased Raghu. This petitioner/A.6 is made an accused in this case, pursuant to the confession made by A.1 to A.5. There is no direct material to connect this petitioner/A.6 with the death of Raghu, which took place on 12.03.2019. There are allegations of beating the deceased Raghu with stones etc., against A.1 to A.5. The deceased Raghu, during his life time, threatened to eliminate A.1 and A.2 and their family members. lt appears to be the motive for the commission of the alleged offence. Under these circumstances, this Court is inclined to grant bail to the petitioner/A.6 under Section 438 of Cr.P.C., on some conditions.

Accordingly, the petitioner/A.G is directed to surrender before the Station House Officer, Wanaparthy Town Police Station, Wanaparthy District, within a period of 15 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/A.6 on bail, on his executing a personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties in a like sum each to his satisfaction. On such release, the petitioner/A.6 shall report before the said Station House Officer on every Wednesday and Sunday between 09:00 AM and 10:00 AM, till filing of the charge-sheet. The petitioner/A.6 shall also abide by the conditions stipulated in Section 438(2) of the Code'of Criminal Procedure, 1973, and shall cooperate with the investigating officer in the investigation of the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
