HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.27353 of 2008 ORDER :

This writ petition is filed seeking a Writ of Mandamus, declaring the proceedings of the 3rd respondent in P1/756(2)/2007-TDR, dated 05.02.2008, rejecting the claim of the petitioner for grant of stagnation increments by counting the continuity of service granted by the Labour Court in I.D.No.69/2002, dated 17-6-2003, as illegal and arbitrary and set aside the same with all consequential benefits including granting of stagnation increments and payment of arrears. When the matter is taken up for hearing, it is submitted by learned counsel for both the parties that this writ petition is covered to be allowed in terms of the orders of this Court in W.P.No.21340 of 2005, dated 03.10.2018.

In view of the same, for the reasons recorded in the order dated 03.10.2018 in W.P.No.21340 of 2005, this writ petition is allowed. The impugned Proceedings issued by the 3rd respondent in P1/756(2)/2007TDR, dated 05.02.2008 is set aside. The petitioner is entitled for grant of stagnation increments with all consequential benefits. No order as to costs.
