Initially this writ petition is filed seeking writ of mandamus declaring action of the respondents in not regularizing service of petitioner, after completion of 240 days and not issuing pay slips and not enrolling him as member of Provident Fund and Employees Family Pension as illegal and arbitrary. Subsequently, W.P.M.P.No.49015 of 2012 was filed to amend the prayer in the writ petition, which was allowed on 20.12.2012. In the said amendment, the petitioner challenges the proceedings No.OS4/255(136)/2011 PO.III, dated 27.11.2012 rejecting the case of the petitioner for regularization of services. Heard learned counsel for the petitioner and Sri N.Vasudeva Reddy, learned Standing Counsel for the respondent Corporation. Learned counsel for the petitioner, while placing reliance on the Award dated 21.04.1999 in I.D.No.
14/96, Proceedings No.OS4/255(15)/2010-PO-III, dated 15.02.2011, Proceedings No.PA/SLO(1)/2011, dated 27.04.2011, Proceedings No.OS4/255(36)/2007-PO-III, dated 04.07.2009, Proceedings No.P3/255(15)/2014-RM:MR, dated 19.12.2014, Proceedings No.Sup(P)/HC/755(319)/96-RM:MR, dated 15.11.1999, Office Order No.P1/785(1)/99-DBK, dated 18.12.1999, Office Order No.P3/255(1)/2009-RM:MR, dated 18.07.2009 submits that services of several persons, who are appointed on contract basis have been regularized.
aforesaid proceedings, his case was rejected by the respondent Corporation.
A perusal of the proceedings referred to above show that services of some persons have been regularized and the said aspect was not taken into account by the respondent Corporation while passing impugned orders against the petitioner. In view of the same, the impugned proceedings No.OS4/255(136)/2011 PO.III, dated 27.11.2012 is set aside and the first respondent is directed to consider the case of the petitioner for regularization of his services, by taking into consideration the orders passed in the case of similarly situated persons referred to above. The above exercise shall be completed within a period of two months from the date of receipt of a copy of this order.
With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, shall stand dismissed. ____________________________ A.RAJASHEKER REDDY, J 27.12.2016 kvs
