HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.6543 of 2019 ORDER:

This Writ Petition is being disposed of at the admission stage with the consent of both the parties.

The petitioner is seeking Writ of Mandamus declaring the action of the third respondent in not passing orders on the appeal preferred by the petitioner on 07.11.2012, as arbitrary, illegal and consequently sought a direction to the third respondent to pass appropriate orders on the appeal preferred by the petitioner. Heard Sri P.Venkateshwer Rao, learned counsel for the petitioner and Sri Vasudeva Reddy, learned Standing Counsel for the respondents.

It has been contended by the petitioner that he was appointed as a contract driver in the year 2007 and ever since he has been working as a contract driver. Petitioner submits that the disciplinary authority had initiated disciplinary action against him and terminated him from the service on 26.04.2011. Thereafter, the petitioner preferred an appeal on 07.11.2012, but the appellate authority did not pass any orders on the appeal in spite of lapse of more than seven years. Learned counsel for the petitioner contends that appropriate orders be passed in the Writ Petition directing the third respondent to pass appropriate orders on the appeal preferred by the petitioner, in accordance with law. Learned Standing Counsel contended that appeal of the petitioner would be considered and appropriate orders would be passed in accordance with law.

Having considered the above submissions made, the Writ Petition is disposed of directing the third respondent - appellate

authority to consider the appeal preferred by the petitioner on 07.11.2012 and pass appropriate orders in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. No costs.

Consequently, Miscellaneous Petitions, if any, pending shall stand closed.
