HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.2842 of 2016 ORDER:

This Criminal Petition is filed by the petitioner seeking to set aside the order dated 22.12.2015 passed in Crl.M.P.No.1808 of 2015 in C.C.No.407 of 2015 on the file of Judicial First Class Magistrate, Palakol, West Godavari District, wherein the trial Court condoned delay of 14 days in preferring the complaint and consequentially quash the proceedings in the said C.C. under Section 482 of Cr.P.C.

Having regard to the reasons stated in the affidavit filed in support of the Crl.M.P.No.1808 of 2015 for delay in preferring the complaint, I do not find any error in the order under challenge and the same is confirmed.

At this stage, learned counsel for the petitioner submits that presence of the accused/petitioner, who is resident of Warangal, may be dispensed with on every date of adjournment, as it would be very difficult for the petitioner to appear before the Court at Palakol, West Godavari District, on every date of adjournment.

Having regard to the fact that the petitioner is a resident of Warangal, his presence in C.C.No.407 of 2015 on the file of Judicial First Class Magistrate, Palakol, West Godavari District, on every date of adjournment, is dispensed with except on the date as and when his presence is required by the said Court. Accordingly, the Criminal Petition is disposed of.

As a sequel thereto, Miscellaneous Petitions, if any, pending shall stand closed.
