The Dist. Collector Warangal v. E.Shyam
HON'BLE SRI JUSTICE S. RAVI KUMAR CIVIL REVISION PETITION No.4546 of 1994 ORDER:
This revision is preferred against the judgment of the Land Reforms Appellate Tribunal, Warangal, in L.R.A.Nos.29, 30 and 31 of 1989 dated 11.08.1992 by the State.
2. This revision is already dismissed against respondents No.2 and 3 on 21.04.2011 for not taking steps against the deceased respondents No.2 and 3. Advocate for petitioner filed a memo on 02.04.2015 stating that respondent No.1 died on 21.02.2013 and the details of legal representatives of respondent No.1 are furnished. In spite of that no steps are taken. As per the death certificate, respondent No.1 died long back i.e., on 21.02.2013 and the claim is already abated. Learned Government Pleader for Arbitration prayed for time on the ground that steps have to be taken and officials have to be contacted for filing necessary L.R. petition. But, as the claim against respondents No.2 and 3 is already dismissed as abated and respondent No.1 died two years back and steps are not taken within the statutory period, I am not inclined to grant any time.
3. Accordingly, civil revision petition is dismissed as abated. No costs.
4. Miscellaneous Petitions, if any, shall stand closed. __________________ S. RAVI KUMAR, J 8th April 2015.
