ORDER
Heard learned counsel appearing for the petitioners and learned Government Pleader appearing for respondents 1 to 4. None appeared for the 5th respondent in spite of service of notice. Challenging registration of Cr.No.378 of 2016 by the 4th respondent, the present writ petition is filed. Learned counsel appearing for the petitioners submits that petitioners are A2 and A3 in Cr.No.378 of 2016, which was registered based on the complaint lodged by the 5th respondent. It is brought to the notice of this Court that A1 in the said crime filed W.P.No.40074 of 2016 and this Court disposed of the same on 21.11.2016, observing as under:
"Considering the grievance of the petitioner and the submissions both the learned counsel, in any event, if the petitioner apprehends arrest in the hands of the 4th respondent, the 4th respondent is directed to complete the investigation in FIR No.378 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. In case, if any charge sheet is filed and summons are received by the petitioner, he shall appear before the Court concerned and execute a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety to the satisfaction of the concerned Court for his future appearance before the concerned Court."
Following the same, this writ petition is also disposed of in terms thereof. No costs.
