HON'BLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.2881 of 2015 ORDER:

This revision is preferred challenging the order dated 13-112015 made in C.C.No.733 of 2014 by the Judicial Magistrate of First Class, Huzurnagar, Nalgonda District, wherein the learned Magistrate dismissed the complaint for default of appearance of complainant under Section 256 Cr.P.C. and consequently accused is deemed to have been acquitted.

Since the impugned order amounts to acquittal of the accused, the petitioner/complainant is at liberty to present an appeal against the said order.

Registry is directed to return the original documents to the petitioner/complainant.

Accordingly, the Criminal Revision Case is closed.

Consequently, the Miscellaneous Petitions pending, if any, in this revision shall stand closed.
