This writ petition is filed seeking to issue a writ of mandamus, declaring the action of respondent No.1 in not transferring respondent No.5 in spite of the report of respondent No.4, request of respondents Nos.2 and 4, and resolution of Nagari Municipal Council surrendering respondent No.5 to the Government for his illegal activities, as illegal, arbitrary, unconstitutional and contrary to A.P.Municipalities Act, 1965 and the Rules made thereunder and consequently to direct respondent No.1 to initiate immediate action and transfer respondent No.5. Heard Sri Ponavolu Sudhakara Reddy, learned counsel for the petitioners and the learned Government Pleader for Municipal Administration and Urban Development.
When the matter is taken up for hearing, it is reported by the learned Government Pleader that respondent No.5 was already transferred in September, 2015, and the cause in this writ petition does not survive and the writ petition has become infructuous. Recording the above submission made by the learned Government Pleader, the writ petition is dismissed as infructuous. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed in consequence.
