HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY WRIT PETITION No.35706 of 2012 25.06.2015 Between:

Weavers Welfare Association, Reptd by its General SecretaryT.Yadagiri, S/o T.Chandraiah

...Petitioner

And:

A.P. Medical Services and Infrastructure Development Corporation, Hyderabad, rptd by its Managing Director and another.

...Respondents

Counsel for the petitioner: Sri Ponnam Ahsok Goud Counsel for respondent No.1: Sri B.S.Prasad Counsel for respondent No.2: GP for Medical Health & Family Welfare (TS) The Court made the following:

ORDER:

This Writ Petition is filed feeling aggrieved by nonimplementation of G.O.Rt.No.733, dated 09.05.2012, whereunder respondent No.1 was directed to procure cloth and linen products from the State Government Undertakings such as Andhra Pradesh State Handloom Weavers Co-Operative Society Limited, etc.

At the hearing, Sri Ponnam Ashok Goud, the learned counsel for the petitioner, submitted that the cause of action for his client to file this Writ Petition arose in the context of a tender notice issued by

respondent No.1 on 31.07.2012.

A perusal of the proceeding sheet shows that no interim order in favour of the petitioner was granted. In the absence of any such interim order, it is reasonable to presume that respondent No.1 would have gone ahead with the tender process and procured the cloth and linen products in pursuance of the said tender notification.

In this view of the matter, I am of the opinion that the cause on which the Writ Petition has been filed does not survive for adjudication.

Accordingly, the Writ Petition is dismissed as infructuous, however, with liberty to the petitioner to avail fresh remedy in the event respondent No.1 does not implement G.O.Rt.No.733, dated 09.05.2012, in future.

As a sequel to dismissal of the Writ Petition, WPMP.No.45376 of 2012 shall stand dismissed as infructuous.
