HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD W.P. No.1824 of 2016 ORDER:
This Writ Petition is filed, under Article 226 of the Constitution of India, to declare the action of the respondent Nos.2 to 5, in pressurizing the petitioners to execute documents of conveyance in favour of the respondent Nos.6 and 7, pertaining to the property of the petitioners in Mallapuram Village, Vidapanakal Mandal, Anantapur District, as arbitrary and illegal. 2) Heard learned counsel for the petitioners and learned Assistant Government Pleader for Home appearing for respondent Nos.2 to 5.
3) The brief facts of the case are that the petitioner No.1 has purchased a land to an extent of Ac.16.50 cents, in S.No.1, and an extent of Ac.7.56 cents, in S.No.111/B of Mallapuram Village, Vidapanakal Mandal, Ananthapuram District, from Smt.Ramajayamma, W/o.late Karanam Suryanarayana Rao, under a registered sale deed bearing document No.767 of 2008 dated 29.04.2008. He has also purchased an extent of Ac.21.89 cents in S.No.111/B of Mallapuram Village, Vidapanakal Mandal, Ananthapuram District, from Smt.Ramajayamma, W/o.late Karanam Suryanarayana Rao vide document No.766 of 2008 dated 29.04.2008. Thereafter, he applied, to the Tahsildar, Vidapanakal Mandal, Anantapur District, for making an entry of his rights in the Record of Rights, and the same was accordingly recorded, and pass book and title deeds were issued in the name of petitioner No.1. Subsequently, he has executed gift settlement deeds in
favour of his three daughters, and daughter-in-law, in respect of separate extents in the year 2012, under different registered documents, and they have been in possession and enjoyment of respective extents.
4) Be that as it may, the 6th respondent, the son of the vendor of the petitioner No.1, has lodged a complaint with the respondent Nos.4 and 5, without any basis. The respondents 4 and 5 basing on the complaint, pressurizing the petitioners to return the land purchased by the petitioner No.1 in the year 2008. 5) It is the case of the petitioners that the official respondents are threatening petitioners with dire consequences that they will register a case under call money scam. Therefore, the petitioners have filed the present writ petition.
6) In the writ petition, an interim order was granted on 22.01.2016 directing the respondents 2 to 5, not to interfere in any civil disputes nor pressurize the petitioners to execute any documents in favour of respondent No.6.
7) Learned Assistant Government Pleader for Home has denied the interference of the police in civil matters and pleaded for dismissal of Writ Petition.
8) In view of the facts and circumstances of the case, the respondents 2 to 5 are directed, not to interfere with the civil matters between the petitioners and respondent No.6. 9) With the above direction, the Writ Petition is disposed of. No order as to costs.
Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
