HON'BLE SRI JUSTICE D.V.S.S. SOMAYAJULU APPEAL SUIT No.1504 of 1998 & TR.A.S. No.281 of 2001 COMMON JUDGMENT:
Learned counsels for both parties are present and the appellants are also present in person. Both the counsels certified the identity of the parties who have also produced the proof of their identity.
The appellants and the respondents clearly stated in the open Court that they have understood the terms and conditions of the compromise. They also stated that with their own willingness, they have entered into this compromise. Hence, the terms and conditions of the compromise are recorded.
Accordingly, the appeal suit is disposed off in terms of the memo of compromise dated 23.11.2017.
The memo of compromise shall form a part of the order of this Court and whenever a copy of the order is applied for, the compromise memo shall also be enclosed along with the same.
As far as Transfer Appeal Suit No.281 of 2001 is concerned, learned counsel for the appellant made an
endorsement stating that he may be permitted to withdraw the same, in terms of the compromise. She also states that the memo was filed in the Court in USR No.2976 of 2017, dated 24.11.2017 requesting the Court to dismiss the Transfer Appeal No.281 of 2001 as withdrawn.
In view of the above submission, the Transfer Appeal Suit No.281 of 2001 is dismissed as withdrawn.
Consequently, miscellaneous petitions, if any, pending in the appeal suit and transfer appeal suit shall stand closed. ___________________________ D.V.S.S. SOMAYAJULU, J Date: 08.12.2017 slk
