HON'BLE SRI JUSTICE SANJAY KUMAR AND HON'BLE MS. JUSTICE J.UMA DEVI W.P.No.32037 of 2017 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) Challenge in this writ petition is to the e-auction notification dated 29.08.2017 issued by the State Bank of India proposing to conduct the auction sale of the secured assets of the petitioners on 25.09.2017.
Conditional interim protection was granted to the petitioners by this Court vide order dated 22.09.2017 in respect of their secured assets, while permitting the auction scheduled to be held on 25.09.2017 to go on.
Sri Maruthi Jadhav, learned Counsel representing Sri B.S.Prasad, learned Counsel for the respondent-Bank, would inform this Court that though the aforestated interim order required the petitioners to deposit Rs.8.00 Crores by 05.10.2017 and another Rs.6.00 Crores by 05.11.2017, they failed to make either of the two deposits. He would further inform this Court that the auction held on 25.09.2017 failed for want of bidders. In the light of the aforestated developments, challenge to the e-auction notification dated 25.09.2017 no longer warrants consideration on merits.
The Writ Petition is accordingly dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
