HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 10808 of 2004 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the inaction of the respondents in regularizing the services of the petitioner from the date of completion of 240 days of service from the date of initial appointment, as illegal and arbitrary. A consequential direction is also sought to the respondents to regularize the services of the petitioner.

When the matter is taken up for hearing, learned standing counsel for the respondents has submitted that during pendency of the writ petition, the case of the petitioner was considered and his services were regularized vide proceedings dated 05.10.2007 and, therefore, the cause in the writ petition does not survive. Learned counsel for the petitioner has not disputed the said fact. In view of the above, the writ petition is dismissed as infructuous.
