HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.14375 OF 2009 ORDER:
The writ petition is filed by the petitioner through the A.P. State Legal Services Authority, Hyderabad to direct the respondents to release the exgrtia/bonus amount of Rs.27,280/- with interest @ 24% p.a from 1999.
Initially, the writ petition was listed on 20.07.2009 for admission and thereafter the matter was adjourned on several times at the request of the learned counsel for the respondents for getting instructions. Finally, the writ petition was admitted on 23.09.2009 and while admitting the writ petition, this Court passed an interim order dated 23.09.2009 in W.P.M.P.No.18843 of 2009 which reads as under: "In the circumstances, there shall be interim direction to release the exgratia/bonus payable to the petitioner within a period of three months from today i.e., 23.09.2009." As can be seen from the main relief sought in the writ petition and the relief which has been granted in W.P.M.P.No.18843 of 2009, the reliefs sought both in the main writ petition and as well as in the Miscellaneous Petition are one and the same.
In other words, the relief sought by the petitioner itself was granted by way of interim order and there remains nothing to be considered now. It may be noted that in the counter-affidavit filed by the 1st respondent, it is categorically admitted that an amount of Rs.27,280/- was earmarked towards bonus/exgratia payable to the petitioner. Having regard to the facts and circumstances of the case and especially in view of the interim order passed by this Court in W.P.M.P.No.18843 of 2009, no further orders are required to be passed in the writ petition.
Accordingly, the writ petition is closed. There shall be no order as to costs. Miscellaneous Petitions, if any pending in this writ petition shall stand dismissed.
