HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.10487 of 2013 ORDER :

This writ petition is filed seeking the following relief :- " ......issue writ order or directions more in the nature of Writ of Mandamus declaring the termination order NO01/1146/2008HCU dated 1452008 passed by the 3rd respondent without conducting departmental enquiry and following the principles of natural justice is illegal and arbitrary and set aside the same and further direct the respondents herein to reengage the petitioner with continuity of service with all consequential service benefits including regularization....." . Heard Sri P.Govinda Rajulu, learned counsel for the petitioner and Sri N.Vasudeva Reddy, learned Standing Counsel for the respondents.

It has been contended by the petitioner that he was appointed as a driver during the year 2007 and while discharging duties as such during May, 2008, the respondents have terminated him from service vide proceedings dated 14.05.2008 without giving any opportunity and without conducting any enquiry. Aggrieved thereby, though he preferred an appeal on 06.06.2008, the respondents neither passed any orders in the said appeal nor reinstated him into service. Hence, the present writ petition.

Learned counsel for the petitioner submits that appropriate orders be passed in the writ petition directing the respondents to consider the case of the petitioner for reinstatement into service by passing appropriate orders on the appeal preferred by the petitioner.

Learned Standing Counsel appearing for the respondents contended that the respondents would consider and dispose of the appeal preferred by the petitioner, if not already disposed of, in accordance with law.

This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider and dispose of the appeal preferred by the petitioner on 06.06.2008, if not already disposed of, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

With the above observations, this writ petition is disposed of. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
