THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CIVIL REVISION PETITION No.805 of 2019 ORDER:
This revision, under Article 227 of the Constitution of India, is filed by the petitioner/defendant, aggrieved by the order dated 12.12.2018 in I.A.No.205 of 2018 in O.S.No.1 of 2001 on the file of the Senior Civil Judge, Manthani.

Heard learned counsel for the petitioner, learned counsel for the respondent and perused the record.

Learned counsel for the revision petitioner/defendant would contend that the Court below declined to allow the application filed by the revision petitioner, to ascertain the present residential address of the original plaintiff and a copy of Aadhar card or Bank Passbook as identification proof. The impugned order is contrary to law and ultimately prayed to set aside the same. 4.
On the other hand, learned counsel for the respondent/plaintiff had supported the impugned order and ultimately prayed to dismiss the petition.

It is brought to the notice of this Court that in the subject suit, evidence was closed and it is coming up for arguments. In the cause title itself, age, name, occupation and residential address of the respondent/plaintiff were given. Furthermore, it is represented by a GPA holder.

Under these circumstances, no further information is required to be given by the respondent/plaintiff. The Court below was justified in dismissing the impugned I.A. by assigning reasons. There are no merits in the revision petition and is liable to be dismissed.

Accordingly, the Civil Revision Petition is dismissed. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
