THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.22268 of 2009 ORDER:

The relief sought for in this writ petition is to declare the action of the respondents, in not granting stay in R.P.No.1236 of 2009 and the I.A filed therein, as arbitrary and illegal.

Aggrieved by the order passed by the Revenue Divisional Officer, Mahabubnagar in July 2009, cancelling the petitioner's authorisation for the fair price shop at Nagargadda Ghanda, Hamlet of Bhairapur Village under the provisions of the A.P. Scheduled Commodities (Regulation of Distribution by Card System) Order, 2001 on the ground of violation of the conditions of authorisation, the petitioner preferred an appeal to the Joint Collector; and, on the ground that no orders of stay were passed therein pending disposal of the appeal, he invoked the jurisdiction of this Court.

By way of an interim order, the petitioner sought a direction that all further proceedings, pursuant to the order of the Revenue Divisional Officer, be stayed till the disposal of the appeal. This Court, by order in W.P.M.P.No.28927 of 2009 dated 19.10.2009, granted interim stay as prayed for. Consequently all proceedings, pursuant to the order of the Revenue Divisional Officer, remained stayed.

As the relief sought for in the Writ Petition is only for grant of stay, during the pendency of the appeal in R.P.No.1236 of 2009 before the Joint Collector, Mahabubnagar, suffice it to direct the 2nd respondent to dispose of the appeal with utmost expedition and, in any event, within two months from the date of receipt of a copy of this order, after giving the petitioner an opportunity of being heard.

The Writ Petition stands disposed of accordingly. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
