THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2501 OF 2015 ORDER:

This Criminal Revision Case is filed by accused challenging the order of the I Additional Sessions Judge, Chittoor dated 8.10.2015 whereby the learned Judge while granting suspension of sentence imposed by the Special Judicial Magistrate of First Class, for Excise, Chittoor in C.C.No.97 of 2013 dated 15.9.2015 for the offence under Section 138 of Negotiable Instruments Act, imposed condition on the petitioner to deposit a sum of Rs.50,000/- and to furnish security for remaining compensation amount imposed by the trial Court. Heard and perused the material on record.

After hearing the counsel for the petitioner and considering the facts and circumstances of the case, the condition imposed by the Court below directing the petitioner to deposit Rs.50,000/- and to furnish security for the remaining compensation is hereby set aside, and instead, the petitioner is directed to execute a bond for a sum of Rs.10,000/- with one surety for his appearance before the lower appellate Court regularly.
