HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.32321 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India aggrieved by the action of the 4th respondent in erecting the fencing in and around the police station. 2.

Heard and perused the material available on record. 3.

According to the petitioner, the land in which the fencing was erected belongs to him, whereas the learned Assistant Government Pleader for Home submitted that in the year 2014 itself, the petitioner filed W.P.No.21577 of 2014 before this Court and the said writ petition was disposed of by this Court and that the petitioner has no right over the land in which the police station was constructed. In reply, the learned Counsel for the petitioner submitted that without paying any compensation to the petitioner, respondents Nos.3 and 4 occupied the land of the petitioner. 4.

Considering the rival submissions, this Court is of the view that in this writ petition, this Court cannot decide the ownership. If the petitioner is aggrieved with any encroachments or occupation of his property by the authorities concerned, he is at liberty to approach the Civil Court or to give a representation to the authorities concerned for speedy remedy. 5.

With the above observations, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
