3. Accordingly, the Criminal Petition is dismissed as withdrawn with liberty to file an appeal under Section 454 Cr.P.C and with an application under Section 14 of Limitation Act, if the period of limitation expires.

4. As a sequel, miscellaneous petitions, if any filed in this Criminal Petition, shall stand closed.
