O R D E R

This writ petition was filed with the following prayer: 'For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue Writ order or direction more particularly one in the nature of a Writ of Mandamus by declaring the action of the 1st respondent in not passing orders on the Lr.1588/Admn.IV3/2004, dt.28-12-2004 of the 2nd respondent by admitting all the petitioners into grant-in-aid and by regularizing their services as illegal, arbitrary and violative of principles of natural justice and violative of Articles 14 and 21 of the Constitution of India and consequently direct the 1st respondent to pass orders on Lr.1588/Admn.IV-3/2004, dt.2812-2004 of the 2nd respondent forthwith and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.'

By order dated 01.11.2007, this Court granted an interim direction to the 1st respondent to pass appropriate orders on the recommendations made by the 2nd respondent, vide letter dated 28.12.2004, within a time frame and communicate the same to the petitioner.

It is now stated that pursuant to the aforestated interim order, proceedings dated 25.01.2008 were issued by the Commissioner of Collegiate Education, Andhra Pradesh, Hyderabad, informing the petitioners that their request for admission into Grant-in-Aid vacancies in degree colleges could not be acceded to and was accordingly rejected.

In the light of the aforestated developments, the cause in this writ petition does not survive for consideration as the Commissioner of Collegiate Education, Andhra Pradesh, Hyderabad, issued the proceedings dated 25.01.2008 negativing the claim of the petitioners and the same is not even subjected to challenge before this Court. The writ petition is accordingly dismissed leaving it open to the petitioners to work out their remedies in accordance with law. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
