THE HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.No.2027 of 2009 O R D E R:

This Writ petition came to be instituted complaining inaction on the part of the first respondent/State Government in passing orders either on the stay petition or in the revision petition dated 06.01.2009 filed by the petitioner against the orders of Agent to Government in SRA.No.7/2006 dated 10.11.2008.

Heard the learned counsel for the petitioner and the learned Government Pleader for respondents.

This Court, while ordering Rule Nisi on 05.02.2000 in WPMP.No.25679 of 2009, granted interim stay of all further proceedings including the dispossession of the petitioner from the land admeasuring 5-19 cents situated in R.S.No.203/1,2,3,4, situated at Buttaigudem village, West Godavari District. No counter affidavit is filed by the respondents. 4.

When the matter is called, it is submitted by the learned counsel for the petitioner that till date the revision filed by the petitioner is pending before the first respondent State Government. 5.

Having regard to the nature of controversy and taking into consideration the submissions of the learned counsel for the petitioner and the learned Government Pleader, this Court is of the considered opinion that ends of justice would be served if the first respondent State Government is directed to pass appropriate orders on the revision petition dated 06.01.2009 filed by the petitioner against the orders passed by the second respondent/ Agent to Government in SRA.No.7/2006, dated 10.11.2008, by continuing the interim orders granted by this Court till the said exercise attains finality.

For the aforesaid reasons, Writ Petition is disposed of, directing the first respondent/State Government to dispose of the revision petition dated 06.01.2009 preferred by the petitioner against the orders passed by the first respondent/Agent to Government in SRA.No.7/2006 dated 10.11.2008, within a period of six months from the date of receipt of a copy of this order, after giving notice and opportunity of hearing to all the stake holders. Pending such exercise, the interim order dated 05.02.2009 granted by this Court in WPMP.No.2562 of 2009 shall remain operative. As a sequel, pending miscellaneous petitions, if any, shall stand disposed of. No costs. ______________ A.V.SESHA SAI, J Date:07.11.2016 grk
