THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.34862 OF 2015 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit the above named Petitioner prays that this Hon'ble Court may be pleased to issue a Writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of second respondent in not investigating the Crime No. 273 of 2015 of P.S. Nagarampalem, Guntur (urban) District against respondents 2 to 20 is arbitrary, illegal and against the principles of natural justice, consequently to direct the second respondent to take up investigation in Crime No. 273 of 2014 of P.S. Nagarampalem, Guntur (Urban) District and take appropriate action against respondents 2 to 20 and pass such other order or orders as this Hon'ble Court may deem fit and proper."

Learned Assistant Government Pleader for Home stated that upon completion of the investigation in Crime No.273 of 2015 which was registered on the file of Nagarampalem Police Station, a final report was filed before the competent criminal court under CFR.No.1751 of 2016 on 23.02.2016. By the said report, the police authorities referred the case as 'false'. Notice to this effect was stated to have been given to the complainant, the petitioner herein, on 19.02.2016.

In the light of the afore-stated developments, it is for the petitioner to take recourse to appropriate remedies in accordance with law, if he is aggrieved by the conclusion arrived at by the police authorities. Reserving liberty to the petitioner to do so, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
