THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13025 OF 2016 ORDER:

This petition is filed by the petitioner-accused No.1 under Section 482 Cr.P.C. seeking to quash the proceedings against him in P.R.C.No.44 of 2016 on the file of the III Metropolitan Magistrate, Cyberabad. Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Sections 420, 406, 507, 109 IPC and Section 3(1)(x)(xii) of SCs & STs (POA) Act. It is alleged that L.W.1 and the petitioner fell in love and A1 promised her to marry. A1 had sexual relationship with L.W.1. Subsequently, A1 failed to marry her and L.W.1 came to know that A1 is going to marry another woman.

Learned Counsel for the petitioner submitted that petitioner has no relationship with the 2nd respondent and the allegations were made to harass the petitioner and his family members. Learned Additional Public Prosecutor opposed this petition. The truth or otherwise of the allegations can be decided after full fledged trial. Therefore, this Court is not inclined to grant the relief sought by the petitioner.

At this stage, the learned Counsel for the petitioner prayed for dispensing with the presence of the petitioner before the trial Court. In view of the above submission, the presence of the petitioner before the trial Court is dispensed with except on the dates when his presence is specifically required by the trial Court. The petitioner is directed to be represented through a Counsel before the trial Court on all hearing dates.

Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________________ JUSTICE RAJA ELANGO Date : 2.9.2016 Nn
