HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE NO.803 OF 2015 ORDER:

This revision is filed by the petitioner-accused aggrieved by the order dated 16.4.2015 passed by the Additional Judicial First Class Magistrate, Tuni, East Godavari District, in Crl.M.P.No.1398 of 2015 in C.C.No.102 of 2014. The petitioner filed the above Crl.M.P. seeking to recall NBWs dated 12.3.2015 issued against him. The trial Court dismissed the said application. Aggrieved by the same, the present revision case is filed. Heard and perused the material available on record. The learned Counsel for the petitioner submitted that the petitioner undertakes to attend before the trial Court without fail on every date of hearing and therefore, the NBWs issued against the petitioner may be recalled.

Having regard to the facts and circumstances of the case, the petitioner is directed to appear before the trial Court and file an application to recall NBWs on or before 23rd June, 2015. On such application being filed, the trial Court is directed to recall NBWs issued against the petitioner on the same day. Further, the petitioner is directed to appear before the trial Court regularly in future on every date of posting of the above C.C. till its disposal.

With the above direction, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. _________________ Justice Raja Elango Dated: 9.6.2015 Nn.
