Respondent (Respondent ir -do-) Petition under Section 482 of Cr.P.C., praying that in the circumstances stated in the petition filed therein, the High Court may be pleased to relax the condition No.2 imposed by this Hon'ble Court in its order dated 27 -04-2021 in Criminal Petition No. 2550 of 2021 to the effect that the petitioner is permitted to appear before the Respondent i.e. Superintendent ofPolice (BS & FB), Bangalore as and when directed by them instead of appearing on every Friday between 12.00 noon and 5.00 P.M, till completion of the investigation, subject to the compliance ofother bail conditions in the order dated2T-04-2021 passed by the Hon'ble High Court. Petition under Section 438 of Cr.P.C, praying that in the circumstances stated in the petition and the grounds filed therein, the High Court may be pleased to direct the Respondent to release the petitioner on Bail in event of his arrest in Crime/FIR.No.RC0782021E0001, dated 06.01.2021 pending before the Principal Special Judge for CBI Cases at Hyderabad; The petition coming on for hearing, upon perusing the petition filed therein, and the orders ofthe High Court dated2'7-4-2021 made in Crl.P. Nos. 2548, 2550 &.2550 of202l, and dated 08-06-2021 made in LA. No. I of 2021, and upon hearing the arguments of Sri K.Keerti Vardhan Reddy, Advocate for the petitioner, and of Sri K. Surender, Special Public Prosecutor, for the Respondent, the Court made the following; ORDER:
"This application is fiIed by the petitioner/accused No.3 seeking to relax the condition of his appearance trefore the Superintendent of Police (BS &FB), Bangalore on every Friday between l2:00 noon and 5:00 PM till completion of investigation, imposed by this Court vide order, d^ted 21 .04.2021 in Crl.P.No.2550 of 2021. Heard both sides.
Learned counsel for the petitioner would submit that as per the directions of this Court, the petitioner is appearing before the Superintendent of Police concerned and hence, the said condition may be relaxed.
Learned Public Prosecutor opposed the petition. Having regard to the averments made in the accompanying affidavit and considering the fact that the petitioner/accused No.3 is appearing before the Superintendent of Police concerned as per the directions of this Court, the said condition is hereby relaxed, However, the petitioner/accused No.3 shall appear before the Superintendent of Police concerned as and when required for the purpose of further investigation, if any.
