HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.5450 of 2018 ORDER:

The issue covered by the present writ petition is squarely covered by the order of another Single Judge of this Court in W.P.No.10545 of 2002, dated 23.06.2009, where the present respondent Nos.3 and 4 were the respondent Nos.1 and 3 in W.P.No.10545 of 2002. The order in W.P.No.10545 of 2002 speaks from the contention of the Hindupur Municipality that the so-called pattas claimed by persons therein 33 in number are fake and bogus and having regard to the above, if at all it is the municipal property and they are unauthorised occupants, Municipality has to issue notice and remove the encroachments after notice and opportunity of hearing by following Section 192 of the A.P. Municipalities Act, 1965 (for short, 'the Act').

With the self same observation, the writ petition is disposed of and the petitioners are at liberty if at all there is any title in their favour to produce along with their objections to the show-cause notice, for the respondents to pass appropriate orders if at all there is any encroachment to remove, thereafter follow Section 147 of the Act. Miscellaneous petitions pending, if any, shall stand closed. No costs.
