This appeal is filed aggrieved by the judgment and decree dated 21.02.2015 in O.S.No.1423 of 2012 on the file of IV Senior Civil Judge, City Civil Court, Hyderabad.

2) Heard the learned counsel for the appellant/2nd defendant and respondent/plaintiff.

3) The trial Court decreed the suit for Rs.7,04,448/- vide its judgment dated 21.02.2015 in O.S.No.1423 of 2012. Aggrieved by the same, the defendant preferred the appeal.

4) Pending the appeal, the parties entered into compromise and the appellant agreed to pay an amount of Rs.5,20,000/- in the form of two cheques bearing Nos.004406 dated 02.11.2015 and 004407 dated 30.11.2015 for Rs.2,60,000/- each drawn on Kotak Mahindra bank, Somajiguda Branch, Hyderabad and the two cheques are already encashed and hence to record the compromise, as no more claims in relation to the suit transaction.

5) Accordingly, the appeal is allowed to the extent of memorandum of compromise. Memorandum of compromise be appended to this order as part of compromise decree.
