THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.14236 OF 2015 ORDER:
This criminal petition under Sections 437 and 439 of Cr.P.C. is filed by the petitioner/A.1 seeking bail in connection with Crime No.768 of 2015 on the file of Patamata Police Station, Vijayawada City, Krishna District registered for the offences under Sections 420, 272 r/w 34 IPC and Sections 103 and 104 of Trade Mark Act, 1999 and Section 63 of Copy Right Act, 1957. Heard and perused the records.
The allegation against the petitioner is that he took a go-down on rent and involved in manufacturing spurious ghee and with the assistance of other accused he used to sell the same under different brands in the open market. Learned counsel for the petitioner submits that the petitioner has not committed any offence as alleged and petitioner was arrested on 25.11.2015 and since then he is in jail.
Considering the fact that most part of the investigation is completed and that the petitioner is in jail from 25.11.2015, this Court is inclined to grant bail to the petitioner.
Hence, the petitioner shall be released on bail on condition of his executing a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with one surety for the likesum to the satisfaction of IV Additional Chief Metropolitan Magistrate, Vijayawada, Krishna District. Further the petitioner shall report before the Station House Officer concerned daily between 10.00 a.m. and 5.00 p.m. until further order.
