HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.5470 of 2018 ORDER:

Heard learned counsel for the petitioner, learned Government Pleaders for Municipal Administration & Revenue respectively for respondent Nos.1 & 4 and Sri N. Praveen Kumar, learned Standing Counsel for respondent Nos.2 & 3 from the oral instructions and perused the prayer in the writ petition with the supporting affidavit.

It is the grievance of the petitioner that under the guise of part of the construction of the petitioner is as if in the Government land or road encroachment, the respondents are choosing to take the law into their hands though there is no encroachment by the petitioner.

It is the submission of the learned Standing Counsel vis-àvis learned Government Pleader that they are following due process of law.

Having regard to the above and by recording the same, the Writ Petition is disposed of with a direction to the respondents without following due process of law demolition cannot be undertaken.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
