THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM Writ Petition No 5477 of 2018 ORDER:

This Writ Petition is filed challenging the action of respondents in proposing to excavate the canal of Velagaleru Lift Irrigation Project connecting from Polavaram Canal to Narsaigudem Tank near Velagaleru Village through the land of petitioner situated in Survey No.147-1A1 of Velagaleru Village, G Konduru Mandal, Krishna District without following the due process of law.

Learned Government Pleader for Irrigation & CAD (A.P.) has placed on record the written instructions received from the Executive Engineer, APSIDC, Vijayawada, dated 22.02.2018, wherein it is categorically asserted that there is no proposal for digging of canal for Velagaleru Lift Irrigation Project in the petitioner' s land and the same is not yet started. It is further asserted that at this point of time the petitioner's land is not required for any sort of works and no work will be executed in her land until completion of the project.

Having considered the submissions made by the learned counsel for petitioner and in the light of the written instructions submitted by the respondents making it clear that

CKR, J W.P.No.5477 of 2018 no land of the petitioner is required at this point of time, recording the said statement, this Writ Petition is closed, leaving it open to the petitioner to work out her remedies as and when necessary.

Accordingly, this Writ Petition is closed. Miscellaneous Petitions, if any, pending shall stand closed. No order as to costs.
