THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.8252 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the action of the respondent police in not taking any action against the 5th respondent for his illegal and fraudulent acts in spite of the written complaint dt. 30-102015 and 9-11-2015, as being illegal, arbitrary, unjust and unconstitutional and consequently direct the respondent police to act upon the above said complaints and take action against the 5th respondent in accordance with Law, and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case."

The Sub-Inspector of Police, I Town Police Station, Kothagudem, Khammam District, furnished written instructions dated 21.03.2016 to the office of the learned Government Pleader for Home, wherein he stated that no complaint was received from the petitioner in Kothagudem I Town Police Station. He further stated that it would always be open to the petitioner to approach the police authorities with the earlier complaints in original or any fresh complaint and action would be taken thereupon.

In the light of the stand taken by the police authorities, Sri Praveen Kumar Veerjala, learned counsel for the petitioner, fairly stated that his client would approach the police authorities again. The writ petition is accordingly disposed of permitting the petitioner to file a fresh complaint or the original of the earlier complaints. Needless to state, in the event any such complaint is made, the police authorities are bound to take action in accordance with the law laid down by the Supreme Court in Lalita Kumari v.

Government of Uttar Pradesh[1].
