This petition is filed, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C.'), seeking for grant of anticipatory bail to the petitioner-accused No. 9 in crime No. 1 of 2018 of Machavaram Police Station, Guntur District. 2.

Heard learned counsel for the petitioner and learned Public Prosecutor (A.P.).

Learned counsel for the petitioner submits that the petitioner is not yet shown as accused but in the remand report, it is mentioned that some more witnesses are to be examined and the complicity of this petitioner and another is yet to be verified. Based on the contents of the said remand report, the petitioner apprehends his arrest.

In the light of the above, this Court finds that it would suffice to direct the police concerned to issue Section 41-A Cr.P.C. notice before effecting the arrest of the petitioner if they propose to arrest him.

With the above direction, the criminal petition is disposed of. Pending miscellaneous petitions if any shall stand closed in consequence.
