HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.2460 of 2009 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Women and Child Welfare for respondent Nos.1 and 2 and learned counsel for respondent No.3.

The case of the petitioner is that she belongs to Scheduled Caste community. She passed 10th Class in first division in 2004. She is eligible to be appointed as Anganwadi Worker. When a notification was issued on 15.11.2007, she applied to the post of Anganwadi Worker in respect of Seetharamapuram Village, Hanumanthunipadu Mandal, Prakasam District. She attended the interview on 15.11.2008. When she came to know that respondent No.3 was appointed, she filed the present writ petition challenging the appointment of respondent No.3. The grounds raised by the petitioner are that respondent No.3 is the second wife to her husband, prior to her appointment, she worked as Vidya Volunteer and was suspended for irregularities, and she possessed lesser qualifications.

A counter-affidavit is filed by the Project Director, District Women and Child Development Agency, Ongole admitting the application submitted by the petitioner, but stating that as on

01.07.2007, the petitioner has not completed 21 years of age. It is also stated that the petitioner secured 20 marks, whereas respondent No.3 secured 29 marks.

In view of more marks obtained by respondent No.3, her appointment cannot be said to be irregular.

The writ petition is accordingly dismissed.
